Terms & Conditions

These Terms and Conditions govern the provision of real estate photography, videography, floor plan production, and 3D/360° virtual tour services ("Services") by the Company HAYYU 360 LTD. By booking or using any of our Services, you agree to be legally bound by these Terms in full. These Terms apply to all work undertaken unless otherwise agreed in writing and form the entire agreement between the Company and the Client.

Scope of Services

The Company provides professional visual marketing services including property photography, video walkthroughs, floor plans, and immersive 3D virtual tours. All services are delivered according to the agreed quotation or package. While every effort is made to ensure accuracy and quality, floor plans are intended for illustrative purposes only and are not guaranteed to meet formal surveying standards unless explicitly stated.

Bookings and Acceptance

A booking is confirmed once acknowledged in writing via email or message. By confirming a booking or instructing work, the Client enters into a binding agreement and accepts these Terms. All bookings are subject to availability, and the Company reserves the right to reschedule or decline bookings where necessary.

Pricing and Quotations

Pricing is based on property size, location, and services requested. All quotations are valid for a limited time and may change if project requirements are altered. Prices are exclusive of VAT unless otherwise stated. The Company reserves the right to correct pricing errors and adjust rates where necessary, including periodic increases aligned with the UK Retail Prices Index.

Payment Terms

Invoices are typically issued upon completion of Services and must be paid within 30 days unless otherwise stated on the invoice. Subscription services are billed in advance and may operate on a minimum term. Late or missed payments may result in suspension of Services, withholding of deliverables, or termination of the agreement. Failure to settle invoices within the timeframe may result in additional interest being charged @ 5%/day, although we would give our clients every opportunity to clarify the reasons why an invoice had not been paid..

Additional Costs

Additional costs such as travel, accommodation, or extended service time may apply depending on the project. These may be included in the quotation or charged separately. Any exceptional expenses will be discussed and agreed in advance wherever possible.

Property Readiness

The Client is responsible for ensuring that the property is fully prepared, clean, and accessible at the scheduled time. All permissions must be obtained prior to the appointment. If the property is not ready or access is unavailable, additional charges may apply, including waiting fees or rescheduling costs.

Cancellations and Rescheduling

Cancellations made within 48 hours of the scheduled appointment may incur a fee or a percentage of the booking value. Where costs have already been incurred, these will remain payable. The Company will make reasonable efforts to reschedule appointments where possible, including in cases of adverse weather conditions.

Delivery

Deliverables are typically provided within 24 to 48 hours unless otherwise agreed. Delivery times may vary depending on project complexity or unforeseen circumstances. The Company is not responsible for delays caused by factors outside its control or by incomplete information provided by the Client.

Creative Control

The Company retains full creative control over all aspects of the work, including composition, lighting, and editing style. While client preferences may be considered, the final output reflects professional judgment and industry standards to ensure high-quality results.

Editing and Accuracy

Editing is limited to professional enhancements such as colour correction and exposure balancing. The Company does not manipulate images in a way that misrepresents the property. Floor plans and dimensions are approximate and should not be relied upon for legal or architectural purposes.

Copyright and Usage

All media produced remains the intellectual property of the Company. Upon full payment, the Client is granted a limited licence to use the media solely for marketing the specified property. The media may not be resold, transferred, or reused for other purposes without prior written consent.

Promotional Use

The Company reserves the right to use any media for marketing and portfolio purposes. Where necessary, the timing of such use will be agreed to avoid conflict with the Client’s marketing activities.

Client Responsibilities

The Client warrants that all materials and information provided do not infringe third-party rights. The Client agrees to indemnify the Company against any claims arising from such content or misuse of the Services.

Complaints and Refunds

Any issues must be reported promptly after delivery. The Company will make reasonable efforts to correct defects. Refunds are only provided where services are materially defective and cannot be remedied within a reasonable timeframe.

Limitation of Liability

The Company shall not be liable for indirect or consequential losses, including loss of business or profits. Liability is limited to the amount paid for the Services or £100, whichever is greater. Nothing in these Terms excludes liability for death or personal injury caused by negligence.

Force Majeure

The Company is not liable for delays or failure to perform due to circumstances beyond its control, including weather conditions, illness, equipment failure, or other unforeseen events.

Privacy and Data Protection

All personal data is handled in accordance with UK GDPR and the Data Protection Act 2018. Information is used solely for service delivery, communication, and billing purposes.

Termination

The Company reserves the right to suspend or terminate services where the Client breaches these Terms or fails to make payment. Certain provisions, including intellectual property and liability clauses, will continue to apply after termination.

Governing Law

These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
